These Terms & Conditions ("Terms") govern your access to and use of the BLC Plant Hire Platform. Please read them carefully.

Operator & definitions

BLC Suppliers and Trading CC, trading as BLC Plant Hire, operates the Platform. Registration: CC/2017/00361. Postal address: P.O. Box 245, Keetmanshoop, //Kharas Region, Namibia. Email: blc.bertus@gmail.com. Telephone: +264 81 603 4139. Coverage: all 14 regions of the Republic of Namibia. Governing law: laws of the Republic of Namibia.

• BLC / We / Operator: BLC Suppliers and Trading CC, trading as BLC Plant Hire, the operator of the Platform.
• Platform: the BLC Plant Hire website, mobile/Android application, and all related services.
• User / You: any person or entity that accesses or uses the Platform in any capacity.
• Equipment Owner / Lister: a User who lists equipment for hire or sale on the Platform.
• Hirer / Renter: a User who books or rents equipment through the Platform.
• Buyer: a User who purchases, or bids to purchase, equipment listed for sale.
• Listing: an advertisement for equipment offered for hire, sale, or a "Wanted" request.
• Booking: a confirmed reservation of equipment for a defined hire period.

1. Acceptance of the Terms

By creating an account, listing equipment, placing a booking or bid, or otherwise using the Platform, you confirm that you have read, understood and agree to be bound by these Terms and all policies referenced in the BLC Plant Hire legal handbook. If you do not agree, you must not use the Platform.

2. Eligibility

• You must be at least 18 years of age and legally capable of entering into a binding contract.
• If you use the Platform on behalf of a business or juristic entity, you warrant that you are authorised to bind that entity.
• You must provide accurate, current and complete information and keep it up to date.

3. The role of BLC - marketplace operator

BLC Plant Hire is a marketplace that connects Equipment Owners with Hirers and Buyers. Except where BLC lists its own equipment, BLC is not a party to the contract of hire or sale between Users. BLC does not own, inspect, warrant or control third-party equipment and is not responsible for the acts or omissions of any User. Any hire or sale contract is concluded directly between the transacting Users.

Where a Listing is marked as belonging to BLC itself, BLC acts as the Equipment Owner and the Equipment Rental Policy applies to that transaction in full.

4. Accounts and security

• You are responsible for maintaining the confidentiality of your login credentials.
• You are responsible for all activity that occurs under your account.
• You must notify BLC immediately of any unauthorised use at blc.bertus@gmail.com.

5. Listings and listing tiers

Equipment Owners may publish Listings under the following tiers. Free listings go live after BLC review; Featured and Premium listings require payment before activation.

• Free - N$0: Basic listing, 1 photo, reviewed by BLC before going live.
• Featured - N$150 / month: Top-of-results placement, "Featured" badge, up to 2 photos.
• Premium - N$350 / month: Featured placement, photo gallery of up to 6 photos, priority review.

BLC reserves the right to review, edit, decline, suspend or remove any Listing that is inaccurate, misleading, unlawful, or in breach of the Acceptable Use Policy, without liability.

6. Advertising slots

Businesses may purchase advertising placements on the Platform, subject to admin approval. Indicative rates are: Hero banner N$700, Inline N$400, Modal N$500 and Footer N$250 per campaign period. Advertising content must comply with the Acceptable Use Policy and applicable Namibian advertising standards.

7. Bookings, bidding and quotes

• Hire: Hirers may reserve equipment through the availability calendar; a Booking is confirmed only once accepted and any required payment is received.
• Sale & bidding: Where a "For Sale" item accepts bids, the highest accepted bid at close forms the basis of a sale contract between Buyer and Owner.
• Quotes: Auto-generated quotes (via email, WhatsApp or PDF) are estimates and are not binding until confirmed in writing by the relevant Owner.

8. Fees and payment

Listing fees, advertising fees and any service fees are payable to BLC by EFT to the account below, or via approved payment gateways (such as PayToday). Payment is due before a paid Listing or advertisement is activated. All amounts are in Namibian Dollars (N$) and, unless stated otherwise, exclude any applicable taxes.

• Bank: Bank Windhoek.
• Account holder: BLC Suppliers and Trading CC.
• Branch code: 486-372.
• Reference: your listing / invoice number.

9. Intellectual property

The Platform, its design, branding, logos and software are owned by or licensed to BLC. You may not copy, reproduce or reverse-engineer any part of the Platform. By uploading content (photos, descriptions), you grant BLC a non-exclusive, royalty-free licence to display and promote that content on and in connection with the Platform.

10. Disclaimers and limitation of liability

• The Platform is provided "as is" and "as available". BLC does not warrant that it will be uninterrupted or error-free.
• BLC gives no warranty as to the condition, quality, safety, legality or fitness of any third-party equipment.
• To the maximum extent permitted by Namibian law, BLC is not liable for any indirect, incidental or consequential loss arising from use of the Platform or any User-to-User transaction.
• Nothing in these Terms excludes liability that cannot lawfully be excluded.

11. Indemnity

You agree to indemnify and hold BLC harmless against any claim, loss or expense arising from your Listings, your transactions with other Users, or your breach of these Terms.

12. Suspension and termination

BLC may suspend or terminate your access at any time for breach of these Terms or the Acceptable Use Policy. You may close your account at any time by contacting BLC.

13. Changes to the Terms

BLC may amend these Terms from time to time. Material changes will be notified through the Platform. Continued use after changes take effect constitutes acceptance.

14. Governing law and jurisdiction

These Terms are governed by the laws of the Republic of Namibia. The parties submit to the jurisdiction of the Namibian courts.
